Description: Proposing to use existing warehouse building as a packaging, labeling, and warehousing facility. 1. clarify with gp update if any changes may occur to make this proposal a permitted use. right now, it can only be allowed if the continuation of a legal non-conforming use can be established (a fertilizer and pesticide storage facility was allegedly discontinued sometime in the past year). otherwise, a general plan amendment and a zone change will be required. the current general plan land use designation is rlm and the zoning is r3p9. corresponding revisions would require gp research & limited manufacturing and il zoning. 2. if legal non-conformity is established, no expansion of the non-conforming use could occur, but an administrative design review will be required for all of the proposed cosmetic improvements, including interior occupancy and ada modifications and resurfacing the the parking lot. no off-site frontage street improvements will be imposed by engineering if the valuation of all improvements is less than $24,000. 3. in addition, an initial study will be required in conjunction with the drc application, including an environmental assessment phase ii as part of a potential mitigated negative declaration. post pre-app mtgs. update: meeting with za 5/8/02: no design review needed for move-in to existing continuing non-conforming per 19.64.070 (a) when the cessation of use of building designed for nonconforming use occurred within the last 12 months; and the interpretation that there is no need for a design review per 19.14.582 (a) the proposed improvements to the existing facility do not constitute alteration of the existing uses or structures on an r-3 (r3p9) property; (b) that this is not an alteration of an industrial project located within the 1985 montgomery annexation area. without a discretionary application, no initial study per ceqa will be required and the environmental assessment documents need only be filed with county environmental health. meeting with applicant 5/9/02: the applicant may move-in, renew the business license, apply for building permits for interior work as necessary such as fire sprinklers, partition walls, but which may not include general repair such as broken glass, replacement of warehouse corrogated steel panels, painting and slurry coating of the existing paved parking areas. in addition, the move-in would be exempt from street improvements per council policy 563-02 (b.1). the applicant agreed to submit a color board and color elevation for review by planning department.
